Party Host Liability

It’s Super Bowl Sunday, and over 100 million Americans will tune in for the big game.  Many people will gather together to watch the game at a Super Bowl Party hosted by friends or acquaintances.  Football, fanfare, food and festivities make these parties an annual tradition. Many Super Bowl Parties also include alcohol.  Sadly, however, Super Bowl Sunday is one of the most dangerous days on American roadways due to the number of alcohol-related crashes. 

In Florida, party hosts can be held liable for injuries or damages caused by intoxicated guests under certain circumstances.  Under Florida’s social host law, hosts that serve alcohol to an already intoxicated guest who is later involved in a car crash or other situation that results in injury or death to themselves or others can be held liable.  Also, a host may face liability for knowingly supplying alcohol to underaged guests or for allowing minors to consume alcohol on their property. 

To avoid social host liability, party hosts should consider these safeguards:

·       Never purchase alcohol for minors.

·       Never allow minors to consume alcohol on your property.

·       Be aware of guests that are intoxicated and stop serving them alcohol.

·       Encourage guests to use taxis and ride-share services.

·       Arrange transportation for any guest that is intoxicated.
